By accessing and using FrameToolkit ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

FrameToolkit provides browser-based media processing tools. All processing occurs entirely within your browser using client-side technologies. Your files are never uploaded to our servers.

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES. To the fullest extent permitted by law, FrameToolkit and its operators:

• Are not liable for any damages arising from the use or inability to use the Service, including but not limited to data loss, corrupted files, processing errors, or browser crashes
• Make no guarantees about the accuracy, reliability, or availability of the Service
• Are not responsible for any consequences of using media processed through the Service
• Disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose

You use the Service entirely at your own risk. Always keep backups of your original files before processing.

You retain all rights to your media files. FrameToolkit:

• Does not claim ownership of any media files you upload, process, or generate using the Service
• Does not store, access, or transmit your files to any server (all processing is client-side)
• Has no access to or control over the content you process
• Is not responsible for ensuring you have the necessary rights to use, modify, or distribute the media you process

You are solely responsible for ensuring you have the legal right to process any media files you use with the Service. Do not process copyrighted material without proper authorization.

You agree to:

• Use the Service only for lawful purposes
• Not process or create content that is illegal, harmful, threatening, abusive, harassing, or otherwise objectionable
• Not attempt to reverse engineer, decompile, or extract source code from the Service
• Not use the Service in a way that could damage, disable, or impair its functionality
• Respect the intellectual property rights of others
• Not use automated systems or software to extract data from the Service for commercial purposes

You agree to indemnify, defend, and hold harmless FrameToolkit, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property, privacy, or other proprietary rights
• Any content you process through the Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRAMETOOLKIT OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or inability to access the Service
• Damages resulting from any conduct or content of any third party
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT OF ONE HUNDRED US DOLLARS ($100) OR THE AMOUNT YOU PAID TO US IN THE LAST SIX MONTHS (WHICHEVER IS GREATER).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations above may not apply to you.

The Service is not intended for use by individuals under the age of 13. If you are under 13 years of age, you may not use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent of your parent or legal guardian.

The Service relies on modern browser technologies (WebCodecs, WebAssembly, etc.). We do not guarantee compatibility with all browsers, devices, or operating systems. Processing large files may cause browser performance issues or crashes depending on your device capabilities.

You acknowledge that the quality, speed, and capabilities of media processing depend entirely on your device hardware, browser version, and available system resources.

The Service may contain links to third-party websites or services that are not owned or controlled by FrameToolkit. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such content, goods, or services available through any such websites or services.

You agree to comply with all applicable export and import control laws and regulations in your use of the Service. You shall not use the Service in any country that is subject to an embargo or that has been designated as a "terrorist supporting" country by relevant authorities.

Since all processing happens in your browser, we do not collect, store, or have access to your media files. We may collect anonymous usage analytics (page views, tool usage) to improve the Service. See our Privacy Policy for more details.

We strive to keep the Service available but make no guarantees. The Service may be interrupted, suspended, or discontinued at any time without notice. We are not liable for any unavailability or downtime.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including features, specifications, and availability of any content, without liability to you.

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified terms. It is your responsibility to review these Terms periodically for updates.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by our authorized representative.

These Terms constitute the entire agreement between you and FrameToolkit regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter.

These Terms and Conditions are governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.

You waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
